As a Seller, you agree to upload, sell, advertise and re-distribute only files for which you have the appropriate rights. This means that you must own the copyright to the digital content you sell or distribute.

When you sell digital content, an agreement is not only made with CashMyJunkFiles.com but also with anyone who buys the content that you own full copyright to and have appropriately licensed any auxiliary content that it may use.

If you sell files on CashMyJunkFiles.com, buyers of your content are given the right to use your content in their projects without paying any further fees or charges after the initial download cost. They may freely use your content in whatever way they choose with the exception that they cannot use your content for redistribution. 

If you do not want to or cannot grant these rights to the buyer then your content cannot be sold on CashMyJunkFiles.com   If this applies to you, Please do NOT upload your files.

What is Copyright? 

You can find a full definition of Copyright on the U.S. Copyright office website and how it relates to international copyright relations. Here is a short description:  

Copyright is a legal concept that gives the creator of an original work exclusive right to it. The copyright holder has the right to choose if anyone else can use, adapt or resell their work and have the right to be credited for that work.  

Only the copyright holder of a work may do the following: 

  • Make copies of the work and distribute them
  • Create derivative works or alter the work in any way
  • Sell the work in either its original version or in an altered form 

The creator of a work retains the copyright to it even if they don’t expressly tell you so.  


Licenses and using other peoples work. 

For you to use another person’s work, you need an express license to do so. For example, when you purchase a stock photo you are actually purchasing the license to use that stock photo in a certain way. Different licenses allow you to do different things. You need to look carefully at licenses to see what they permit and what they do not. Specifically, to use an asset like a photo, music loop or code snippet, you need a license that allows the asset’s use in items for resale and redistribution.  

In plain English, the license has to say that you can use it in something you’re selling or distributing. If you don’t have such a license you may be unlawfully profiting off someone else’s work! 


What happens if there doesn't appear to be a license?  


Oftentimes you will find something that you wish to use which doesn't appear to be licensed. For example, you may have followed a tutorial which doesn’t expressly permit or forbid its use in an item for resale and redistribution. In this situation, you must contact the original copyright holder and get written permission.

What is Copyright Infringement? 


Copyright Infringement or Violation is the unauthorized use of work that is covered by copyright. If you use, alter or sell someone else’s work, you are violating their copyright, thereby, breaking the law.

REQUIREMENTS NECESSARY TO COMPLY WITH COPYRIGHT LAW

  • The file must NOT include any brand names, logos or trademarks.

For example: You cannot use McDonald’s logo, even if you have recreated it, photographed it, or altered it and you cannot use a photo of a watch if the brand name of the watch is legible.

  • The file must NOT include patented and trademarked product designs such as music players, computers, cars, toys and so on. 

For example: You cannot use an iPod, iPhone or Ferrari in your file, even if you have recreated it, photographed it, or altered it.

  • The file must NOT include photographs or replications of artworks such as paintings, sculptures and some architectural buildings.

For example: You cannot use the Mona Lisa in a template design and you cannot use a photo or replication of the Sydney Opera House or Eiffel Tower, both of which are copyright protected monuments.

  • The file must NOT be based on any other file. 

For example: You cannot submit a website template that is similar to an established website and you cannot submit a file which is similar to a file for sale on another (or the same) website.

  • The file must NOT be based on a tutorial.

For example: You cannot submit a file that you created by following a tutorial, in whole or in part and you must NOT upload files that have been decompiled from another file, even if you alter it significantly.

  • The file must NOT use free or purchased components from any other source without an express license to do so.

For example: You cannot download a file then use part or all of it in a file for sale.

  • The file must NOT use or contain any Government or Military Property.

For example: You cannot submit a file that contains the Presidential Seal or Military Insignia.

  • You must NOT purchase or download any file and then resell it.
  • You must NOT purchase or download any file, alter it, and then resell it.

For example: You cannot submit a file that you have purchased or downloaded from another source.

  • The file must NOT include a recognizable private location unless you include a location release.
  • You must NOT use photos, videos or sounds in your files unless you have a license to resell them.

The only digital media you can use in your file is content that you create or record yourself, and media purchased under an appropriate license.
